Liability Release Waiver

I, ____________________, HEREBY AGREE TO THE FOLLOWING:

In participating in any of the activities offered by Shizen Sanctuary, including but not limited to meditation and healing classes and/or workshops, aura readings, sound healing, light therapy, and activities involving movement such as qigong and qi yoga, I warrant that I am physically, mentally, and emotionally fit enough to participate. I recognize that none of the activities are a substitute for mental or medical attention, examination, diagnosis, or treatment. I fully understand that there are inherent risks involved in any of these activities, including without limitation, personal injury, injury to others, injury to property, stress (mental, emotional, and/or psychological), bodily harm, death, and other potential hazards. I voluntarily choose to participate in these activities, and assume all risks associated with them.

I fully understand that it is my responsibility to listen to my body and emotions and respect my limits, and to refrain from performing any physical postures to the extent of strain or pain, always modifying as needed. I should consult a physician and/or certified health practitioner prior to beginning any activity program, especially if I have a pre-existing condition or am pregnant, and to notify the teacher / facilitator of any serious illness or injury before each class, workshop, session, etc.

I understand that the teacher, facilitator, and/or staff has the right to refuse my participation on medical, fitness, or any other grounds. Shizen Sanctuary offers no promises for any changes to one’s physical, mental, emotional and spiritual condition. I understand that I am totally responsible for my own healing.

Waiver & Release: In consideration of being permitted to participate in these activities, I, for myself, my heirs, personal representatives, or assigns, do hereby release, waive, discharge, and covenant not to sue Shizen Sanctuary, its directors, officers, employees, instructors, facilitators, assistants, and agents from liability from any and all claims, including negligence, resulting in personal injury, accidents, or illnesses (including death), and property loss arising from, but not limited to, participation in these services. 

Indemnification: I agree to indemnify and hold harmless Shizen Sanctuary, its directors, officers, employees, instructors, facilitators, assistants, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement in these services and to reimburse them for any such expenses incurred. 

Severability: I agree that if any portion of this waiver is held invalid, the remainder will continue in full legal force and effect.

Acknowledgement of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily. By signing this waiver, I completely and unconditionally release all liability to the greatest extent allowed by law. I attest to the fact that I am of sound mind and body in making these statements.

IN ADDITION TO THE ABOVE, I HEREBY CONSENT to the use of my name, likeness, portrait, picture or photograph, and acknowledge and agree that my name, portrait, likeness, picture or photograph may be used on the Shizen Sanctuary website (www.shizensanctuary.com) and/or used on Shizen Sanctuary’s social media, including, without limitation, Facebook, Instagram and Twitter, and in promotional products, including, without limitation, publications, commercial tie-ins, videos, posters, and displays.
